Terms of Service

These Terms govern your use of thesetupagency.com and any related services (the "Service") operated by The Setup Agency. By creating an account, purchasing a course, or otherwise using the Service, you agree to these Terms.

1. Eligibility. You must be at least 16 and able to enter into a binding agreement in your country. Accounts are personal — do not share your login.

2. Accounts. You are responsible for keeping credentials safe and for all activity on your account. Notify us immediately of unauthorised use.

3. Courses & lifetime access. Purchase grants lifetime access to that course on your account, for as long as The Setup operates the Service. If discontinued, we give at least 30 days notice and, where possible, a way to download materials.

4. Payments. Prices in local currency at checkout. Payment via manual bank transfer, FIB, Super Qi, or another displayed method. Access granted after we verify the transfer (usually within 24 hours). Prices include applicable local taxes unless stated.

5. No refunds. All course sales are final. See the Refund & Payment Policy for the narrow exceptions.

6. Certificates. Issued on course completion and verifiable via a unique code. Personal, non-transferable, revocable on cheating or fraud.

7. Acceptable use. No sharing/resale/redistribution of course materials, no reverse-engineering or scraping, no bypassing paywalls, no illegal or infringing content, no impersonation, no spam.

8. Intellectual property. All course content is owned by The Setup Agency or its licensors. Purchase grants a personal, non-exclusive, non-transferable licence to view content for your own learning. Your uploads remain yours; you grant us a licence to host and display them to operate the Service.

9. Marketplace. Brands and creators contract directly through The Setup. Where escrow is available, funds are held until the brand approves the deliverable; the platform commission stated at deal time is deducted before release. The Setup is a facilitator, not a party to the underlying contract.

10. Third-party services. Payment processors, AI providers, and email delivery are also subject to their own terms.

11. Disclaimers. The Service is provided "as is". We do not guarantee any specific outcome, income, follower count, or job result. All implied warranties are disclaimed to the maximum extent permitted by law.

12. Limitation of liability. To the maximum extent permitted by law, our total liability is limited to the amount you paid us in the 12 months before the claim. No liability for indirect/consequential damages.

13. Termination. Close your account any time from settings. We may suspend for breach, fraud, or where required by law. Sections 5, 8, 11, 12, and 14 survive termination.

14. Governing law. Republic of Iraq. Disputes resolved by the competent Iraqi courts, without prejudice to mandatory consumer-protection rights in your country of residence.

15. Changes. Material changes notified by email or in-app at least 14 days before taking effect.
